Three Accused of Heidelberg Burglary Going to Trial

Heidelberg police filed charges against three men in connection with a burglary in the borough in December.

Three men accused of burglarizing a Heidelberg home in December will go to trial on most of the charges following their preliminary hearing before District Judge Gary Zyra.

Charges of burglary, conspiracy, theft, receiving stolen property, possessing an instrument of crime and criminal use of a communications facility against David Barton, 26, of Scott Township, were waived to court during his preliminary hearing on April 11.

James Comley, 30, of Heidelberg, waived to court charges of conspiring to commit burglary, false swearing to police, conspiring to commit theft and possessing an instrument of crime. A felony charge of criminal use of communication facility was withdrawn during his preliminary hearing on the same day.

Benjamin Jury, 29, of Houston, Pa., waived to court charges of burglary, conspiracy, theft, and receiving stolen property. A subsequent conspiracy charge was withdrawn.

Police said the three men burglarized a home in the 200 block of Hogans Way on Dec. 11 and various items inside were taken.

Barton is being held in Allegheny County Jail on a $10,000 bond. Comley and Jury are free while awaiting trial.

The formal arraignment for all three is scheduled for May 30 at 11 a.m. at the Allegheny County Courthouse.
